Terms of Service Agreement for Penpest

This agreement is between Penpest, a pest management company registered in Australia, and the customer who has requested the service. By ordering and obtaining the services, the customer agrees to the following terms and conditions:

Service Provision

Penpest will provide the service as agreed with the customer, using the methods and products that are suitable for the pest problem and the site conditions. Penpest will endeavour to deliver the service on the scheduled date and time, but may need to reschedule or cancel the service due to weather, site access, technician safety, staff availability, non-payment, or other factors beyond its control. In such cases, Penpest will notify the customer as soon as possible and arrange an alternative date and time for the service.

Customer Responsibilities

The customer is responsible for preparing the site for the service, as instructed by Penpest. This may include removing or covering food, utensils, plants, furniture, clothing, toys, and other items that may be affected by the treatment. Failure to properly prepare the site may result in Penpest applying exclusions to the service at its own discretion. The customer is also responsible for vacating all people and animals from the premises for at least 4 hours after the service, or as otherwise specified by Penpest. Where the customer is unable to vacate persons or animals from the premises, the customer has informed Penpest of this and recognises that some areas of the site may not be treated or that alternative products may be used.

Payment and Refunds

The customer agrees to pay for the service in full prior to the service or by invoice no later than 30 days from the day of the first service. The customer can pay by cash, cheque, credit card, or bank transfer. The service is non-refundable, unless Penpest fails to provide the service as agreed or breaches any applicable laws or regulations. In the case that the service does not meet the standards set out in this agreement and the warranty period has not passed, Penpest may provide supplementary services at no extra cost to the customer, in order to reach the agreed outcome.

Warranty and Claims

Penpest offers a warranty for its services, as specified in the service agreement. The warranty covers any re-infestation or recurrence of the pest problem within the warranty period, subject to certain conditions and exclusions. The warranty does not cover any damage or loss caused by pests before, during, or after the service. The warranty also does not cover any pest problems that are outside the scope of the service agreement or that are caused by factors beyond Penpest's control. The customer should contact [email protected] if they believe they are entitled to a warranty claim.

Customer Recommendations

The ongoing effectiveness of the service depends on the customer carrying out the recommendations outlined by Penpest. These may include keeping the site clean and tidy, sealing any gaps or cracks, disposing of any rubbish or clutter, repairing any leaks or moisture problems, trimming any vegetation or branches, and avoiding any actions that may attract pests or interfere with the treatment. The customer acknowledges that failing to follow these recommendations may reduce or void the warranty and increase the risk of pest infestation.

Limitation of Liability

Penpest's liability for any claims arising from or relating to this agreement is limited to the amount paid by the customer for the service. Penpest is not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, personal injury, property damage, or emotional distress. This limitation applies even if Penpest has been advised of the possibility of such damages.

Insurance

Penpest holds public liability insurance with a maximum claim of $5 million and professional indemnity insurance with a maximum claim of $500,000. These insurances cover any claims made against Penpest by third parties for bodily injury or property damage caused by Penpest's negligence or breach of duty in performing its services.
